Judge tosses Stormy Daniels' defamation suit against Trump

But now, Daniels, an adult film actress and director, says people think she's "in charge of saving the world", and it's become an "emotionally overwhelming" duty.

The lawsuit from Daniels, whose real name is Stephanie Clifford, asked for damages stemming from statements from Trump calling her a liar for claims that she was paid to keep quiet about their extramarital relationship before the 2016 election.

Trump tweeted that the man was "nonexistent" and that Daniels was playing the "fake news media for fools".

Harder said Mr. Trump is "entitled to an award of his attorneys' fees against Daniels".

Cohen pleaded guilty in August to campaign finance violations alleging he coordinated with Trump on a hush-money scheme to buy the silence of Daniels and a Playboy model who alleged affairs.

The ruling is a blow for Daniels and her lawyer, Michael Avenatti, who has raised a national profile from his legal battles against the president and is contemplating a presidential bid in 2020.

In the ruling, U.S. District Judge James Otero said the tweet "constitutes "rhetorical hyperbole" normally associated with politics and public discourse in the United States" that is protected by the First Amendment. "The First Amendment protects this type of rhetorical statement", Otero wrote. It also calls the lawsuit a "fishing expedition" and finds that Daniels has failed to show that Trump "acted with actual malice or reckless disregard for the truth".

A judge has dismissed the lawsuit from adult film worker Stormy Daniels against President Donald Trump and ordered that she pay the president's attorney's fees.

"Trump's contrary claims are as deceptive as his claims about the inauguration attendance", Avenatti tweeted Monday night.

Trump and his former personal lawyer, Michael Cohen, want the court to toss out the litigation as moot.

Avenatti filed a notice of appeal Monday evening in Daniels' defamation case against Trump.

Daniels has said she had sex once with Trump in 2006, and carried on a friendship with him for about a year.
