Apex Court Declares Legal Marijuana For Personal Use

South Africa's Constitutional Court on Tuesday ruled that the country's ban on possession, consumption and private cultivation of cannabis was "unconstitutional", in effect decriminalizing the recreational use of the popular psychoactive substance.

Unlike in USA states, where cannabis reform has been enacted through legislation or public votes, South Africa's legalization comes from a ruling of the country's highest court in response to a case brought by cannabis activists.

South Africa's government had opposed its legalisation, arguing the drug was "harmful" to people's health, according to BBC reports.

Here are the details.

"It is true that there will be cases where it will be clear from all the circumstances that the possession of cannabis by a person is for personal use or consumption".

In 2017, a court in the western Cape province (south) had held unconstitutional the prohibition for adults to consume cannabis at home.

South Africa joins a number of countries that have taken a similar step, among them Canada and Portugal. It also says that right to privacy "extends beyond the boundaries of a home".

In the world, the legal status of the use of cannabis varies greatly.

It will, however, remain illegal to use cannabis in public, and to sell and supply it.

Adults who used marijuana in private would be protected by the ruling until the law was amended.

The court also ordered parliament to draft new laws within 24 months to reflect the order.

Per the court's ruling, South Africans are free to smoke weed and even grow it for private use.

"We use cannabis for anxiety, colic in children".
