Supreme Court to Decide on Transfer of Kathua Gangrape Case from J&K

"People with saffron flags are not the authority to decide about who is guilty and who is not", he said, adding that a nation-wide protest will be organised to demand action against the lawyers, saying they not only tried to protect the accused in the Kathua murder case but also threatened her lawyer and attempted to prevent the police from filing a chargesheet.

The plea further says that politicians must be stopped from meeting the juvenile accused in the case and that the status report of the case should be submitted to the Supreme Court as the case proceeds. He also sought safety and security from the court in his plea.

At the outset, the victim's counsel Indira Jaising, who mentioned the matter for an urgent hearing in the forenoon, said the "biological father" of the victim had no grievance with regard to the police probe. "I will tell this to the Supreme Court". The victim's father had also asked the apex court for adequate security for family members of the victim, the local Advocate Rajawat and her family members and Advocate Talib Hussain. The PIL filed by the victim's lawyer, seeks the transfer of case outside the J&K to Delhi. The chargesheet also names investigating officers head constable Tilak Raj and Sub-Inspector Anand Dutta, who allegedly took Rs 4 lakh from Ram and destroyed crucial evidence.

Meanwhile, Kathua Sessions Judge Sanjeev Gupta, earlier on Monday, postponed the case's hearing to 28 April as the crime branch of the J-K Police had so far not provided the copy of the charge sheet to the accused persons. As per reports, Supreme Court will be hearing a plea filed by the victim's father over the transfer of case at around 2 PM today.

The bench said those policemen providing security to the victim's family and others will be in plain clothes. As per the chargesheet filed in the case by the police, the minor girl was kept in a temple for nearly a week.

The court had said on Friday that access to justice can not be obstructed, after local lawyers tried to stop filing of the chargesheet in the case last week. Their lawyers have requested the court that the accused should undergo narco-test. Police investigations revealed she was held captive inside a temple, sedated and repeatedly raped before her murder.
