Sohrabuddin case judge's death: SC to hear PIL on probe

Lone's petition was mentioned before a bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud on January 11 and it sought a probe saying there were several contradictions emerging in the matter.

At the time of his death, Loya was presiding over the CBI court hearing the alleged Sohrabuddin Sheikh fake encounter case.

A Bench of Justices Arun Mishra and Mohan Shantanagoudar heard the matter today, and later adjourned it to Monday, January 15.

The matter will be heard on Friday. "If the court goes ahead with the hearing, it may have implications before the high court", the Hindu reported Dave as saying. Loya was later found dead in mysterious circumstances while attending a wedding in Nagpur between the night of 30 November and the early morning of 1 December 2014.

Significantly, Steyn's career has been greatly affected due to injuries. A team spokesman said the injury was being assessed and treated.

The bench said it will look into the petitions but will also consider the objections raised.

The issue came under the spotlight in November a year ago after media reports quoting his sister fuelled suspicion about the circumstances surrounding his death and its link to the Sohrabuddin case. In his plea, Poonawala contended that the circumstances around the death of the judge were questionable and mysterious.

Senior advocate Indira Jaising, who was also present in the courtroom, said she also had instructions from Bombay Lawyers' Association to pray that the top court should not hear this matter.

Sohrabuddin Sheikh was killed in 2005 in an alleged fake encounter by a team of the Gujarat police, which claimed that he was a member of the Lashkar-e-Toiba terrorist outfit. The case has been a contention of doubt, as Loya's family allege that he was taken to the hospital without any respectable supervision and died because of neglect, while Justice Gavai has said that he was sent to the hospital along with a court official and a judge who hailed from Mumbai.
